These Terms of Service (“Terms”) govern your access to and use of the website located at www.hubbardchapel.com (the “Site”) and the venue rental and event services offered by Hubbard Chapel & Community Center (“Hubbard Chapel,” “we,” “us,” or “our”), located at 2934 H Street, Hubbard, Oregon 97032.By accessing or using the Site, submitting an inquiry, or entering into any service or rental agreement with Hubbard Chapel, you (“you” or “User”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.
These Terms do not replace or supersede any signed event rental agreement, venue contract, or other written agreement you enter into with Hubbard Chapel for specific services. In the event of any conflict, the terms of the specific signed agreement shall govern.
1. Use of the Site
1.1 Permitted Use
You may access and use the Site for lawful purposes in accordance with these Terms. Specifically, you may browse information about our venue and services, submit inquiries and contact forms, and access resources and content we make available.
1.2 Prohibited Conduct
You agree not to:
• Use the Site in any manner that violates any applicable federal, state, local, or international law or regulation
• Transmit any advertising or promotional material without our prior written consent, or engage in unsolicited commercial communications
• Impersonate or attempt to impersonate Hubbard Chapel, an employee, another user, or any other person or entity
• Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which may harm Hubbard Chapel or users of the Site or expose them to liability
• Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission
• Introduce any viruses, trojan horses, worms, or other material that is malicious or technologically harmful
• Attempt to gain unauthorized access to any part of the Site or any server, computer, or database connected to the Site
• Attack the Site via a denial-of-service attack or a distributed denial-of-service attack
2. Intellectual Property

The Hubbard Chapel name, logo, and tagline “Your Forever Starts Here,” and all related marks, names, and logos are trademarks or service marks of Hubbard Chapel. You may not use these marks without the prior written permission of Hubbard Chapel.
3. User-Submitted Content
If you submit any content to us through the Site—including inquiries, reviews, testimonials, photos, or other materials—you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such content in any media now known or hereafter developed, in connection with our services and marketing. You represent and warrant that you own or have the necessary rights to the content you submit, and that the content does not violate these Terms or any third-party rights. 4. Venue Services and Rental Agreements
4.1 Inquiry and Booking Process
Submitting an inquiry through the Site does not constitute a reservation, booking, or binding agreement. A confirmed booking is established only upon execution of a signed venue rental agreement and receipt of any required deposit.
4.2 Separate Agreements
All venue rentals, event services, and related engagements are subject to a separate written agreement that will set forth the specific terms and conditions, including pricing, payment schedule, cancellation policy, event rules, and liability allocation. These Terms apply to your use of the Site and general interactions with Hubbard Chapel and do not govern the specific terms of any venue rental or event contract.
4.3 Availability
Venue availability displayed on the Site or communicated verbally is not a guarantee of availability. Dates are confirmed only upon execution of a signed agreement and receipt of a deposit.
4.4 Pricing
Pricing information provided on the Site is for informational purposes and is subject to change without notice. Final pricing will be confirmed in your written rental agreement.
5. Third-Party Links and Services
The Site may contain links to third-party websites, services, or platforms, including but not limited to social media platforms, online wedding directories, mapping services, and advertising platforms. These links are provided for your convenience only. We have no control over the content or practices of those sites and accept no responsibility or liability for them or for any loss or damage that may arise from your use of them.Your use of third-party websites and services is governed by their own terms of service and privacy policies. We encourage you to review those policies before providing any personal information to such third parties.
6. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HUBBARD CHAPEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.HUBBARD CHAPEL DOES NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE; (C) THE QUALITY OF ANY SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SITE WILL MEET YOUR EXPECTATIONS; OR (D) ANY ERRORS IN THE SITE WILL BE CORRECTED.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUBBARD CHAPEL, ITS OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) ANY CONTENT OR INFORMATION OBTAINED FROM THE SITE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (D) ANY OTHER MATTER RELATING TO THE SITE.IN NO EVENT SHALL HUBBARD CHAPEL’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

8. Indemnification
You agree to defend, indemnify, and hold harmless Hubbard Chapel and its officers, directors, employees, members, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Site; (c) your violation of any applicable law or regulation; (d) any content you submit to the Site; or (e) your infringement of any intellectual property or other rights of any third party.

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Marion County, Oregon for the resolution of any disputes arising out of or related to these Terms or your use of the Site.

12.3 Class Action Waiver
To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
